Introduction

Welcome to Seven Eleven Taxi Inc. (“A Seven Eleven Taxi Inc.,” “the Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our services, including our website, mobile application, Interactive Voice Response (IVR) system, and transportation services.

By using our services, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree with these Terms, please do not use our services.

Applicability of Terms

These Terms of Service apply to both individuals and businesses who use, book, or benefit from the services of A Seven Eleven Taxi Inc. The person or entity making the booking is responsible for ensuring that all passengers, including employees, colleagues, clients, guests, or any third parties riding under the booking, comply with these terms. This responsibility includes, but is not limited to, any damages, cleaning fees, safety violations, or breaches of our User Conduct policy.

You assume full responsibility for the conduct and actions of anyone you authorize to travel using your reservation.

Service Description

A Seven Eleven Taxi Inc. provides taxi transportation services in Brampton, Orangeville, and surrounding areas. Our services can be accessed through:
  • Our website
  • Our mobile application
  • Our IVR telephone system
  • Direct telephone calls
  • Street hails (where permitted by local regulations)

User Accounts

Account Creation

To use certain features of our services, you may need to create an account. When creating an account, you agree to provide accurate, current, and complete information about yourself and/or your business. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Termination

We reserve the right to suspend or terminate your account at our discretion if:
  • You violate these Terms
  • You engage in fraudulent activity
  • You use our services in an inappropriate or illegal manner
  • You consistently cancel rides after drivers have been dispatched

Booking and Cancellation Policy

Booking Services

You may book our services through our website, mobile application, IVR system, or by calling our dispatch center. By booking a ride, you agree to pay for the services provided according to our current rate schedule.

Cancellation and Refund Policy

Our cancellation and refund policy is as follows:
  1. Standard Bookings (On-Demand):
    • If you cancel before a driver is dispatched, no cancellation fee will apply.
    • If you cancel after a driver has been dispatched but before they arrive at your pickup location, no cancellation fee will apply.
    • If you cancel after the driver has arrived at your pickup location, a $10.00 cancellation fee will apply.
    • If you do not show up for your ride within 10 minutes of the driver’s arrival (“no-show”), a $10.00 fee will apply.
  2. Pre-Booked Rides:
    • Cancellations made 24 hours or more before the scheduled pickup time will receive a full refund.
    • Cancellations made less than 24 hours before the scheduled pickup time may be subject to a $10.00 cancellation fee.
    • No-shows will be charged the full fare or a $10.00 fee, whichever is less.
  3. Pre-Paid Rides:
    • If you pre-paid for your ride and cancel 24 hours or more before the scheduled pickup time, you will receive a full refund.
    • If you pre-paid and cancel less than 24 hours before the scheduled pickup time, a $10.00 cancellation fee may be deducted from your refund.
    • If the driver arrives and you cancel or do not show up, a $10.00 fee will be deducted from your refund.
  4. Exceptions:
    • Refunds may be issued in cases of documented emergency, service failure on our part, or proven fraudulent activity.
    • A Seven Eleven Taxi Inc. reserves the right to review refund requests on a case-by-case basis.
  5. Processing Time:
    • Refunds will generally be processed within 5-7 business days, depending on your payment method and financial institution.
A Seven Eleven Taxi Inc. reserves the right to deny service to customers who repeatedly book and cancel rides.

Payment Terms

Fare Calculation

Fares are calculated based on:
  • Distance traveled
  • Time spent in the vehicle
  • Base fare and applicable fees
  • Any additional charges (waiting time, multiple stops, etc.)
All fares are metered unless a flat fee quote is provided and accepted prior to the ride.

Payment Methods

We accept the following payment methods:
  • Cash
  • Credit cards
  • Debit cards
  • Apple Pay and Google Pay
  • Payments through our mobile application
  • Interac e-Transfer
  • Over-the-phone credit card payments
  • Cheques (available for corporate accounts only)

Fare Disputes

If you believe you have been incorrectly charged, please contact our customer service within 7 days of the ride. We will investigate all legitimate fare disputes and make adjustments where appropriate.

Chargeback Policy

By using our services, you agree not to dispute or request a chargeback for properly delivered rides. If you believe you’ve been incorrectly charged, you must first contact our customer support team at contact@seveneleventaxi.ca/(905) 454-9999 within 7 days of the charge to resolve the issue before initiating a chargeback with your payment provider.

Any chargeback initiated without first attempting to resolve the matter through our support channels may result in suspension of your account, collection of the disputed amount plus associated fees, and/or termination of services. We reserve the right to contest any chargeback claims and provide evidence of service delivery, including but not limited to GPS records, driver confirmation, and account activity logs.

Vehicle Cleanliness and Damage Policy

A Seven Eleven Taxi Inc. strives to maintain clean and comfortable vehicles for all passengers. To ensure this standard is met, we enforce the following cleanliness and damage policy:

Cleaning Fee

A cleaning fee of $80.00 will be charged in cases of:
  • Food or beverage spills
  • Vomiting or bodily fluids
  • Excessive dirt or debris left in the vehicle
  • Any substance that requires professional cleaning
  • Littering that requires special disposal

Damage Fee

A damage fee of up to $100.00 may be charged for:
  • Tears, cuts, or burns to upholstery
  • Scratches or damage to interior components
  • Broken windows or damaged exterior
  • Tampering with or breaking vehicle equipment
  • Any damage that renders the vehicle temporarily unusable

Assessment and Billing

  • Our driver will document and report any mess or damage at the end of your ride
  • You will be notified of any cleaning or damage fees before they are charged
  • Photographic evidence may be collected to support the assessment
  • If the actual repair or cleaning costs exceed our standard fees, you may be responsible for the full amount
By using our services, you agree to take reasonable care of our vehicles and accept responsibility for any damage or excessive mess caused during your ride.

User Conduct

When using our services, you agree not to:
  • Use our services for any illegal purpose
  • Harass or harm our drivers or other staff
  • Damage or vandalize our vehicles
  • Bring prohibited items into our vehicles
  • Engage in disruptive behavior during your ride
  • Submit false information when booking rides
  • Attempt to defraud the Company or its drivers
Violation of these rules may result in service denial, account termination, and/or legal action.

Lost Items

A Seven Eleven Taxi Inc. is not responsible for items left in our vehicles. However, we will make reasonable efforts to locate and return lost items when reported. If you believe you left an item in one of our vehicles, please contact our customer service immediately.

If we locate your lost item, we may charge a reasonable fee for returning it to you, based on the driver’s time and distance traveled.

Service Availability

We strive to provide reliable service 24 hours a day, 7 days a week. However, we do not guarantee that our services will be available at all times or in all locations. Service availability may be affected by:
  • Weather conditions
  • Traffic
  • Driver availability
  • Technical issues
  • Other factors beyond our control

Limitation of Liability

To the maximum extent permitted by law, A Seven Eleven Taxi Inc. shall not be liable for:
  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits or revenues
  • Lost time or opportunities
  • Any other losses arising from your use of our services
Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific ride that gave rise to such claim.

Indemnification

You agree to indemnify, defend, and hold harmless A Seven Eleven Taxi Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with:
  • Your access to or use of our services
  • Your violation of these Terms
  • Your violation of any third-party right
  • Your conduct in connection with our services

Insurance and Safety

A Seven Eleven Taxi Inc. maintains insurance coverage as required by applicable laws and regulations. Our drivers are properly licensed and trained according to local requirements.

While we prioritize safety, we cannot guarantee that accidents or incidents will not occur. By using our services, you acknowledge and accept the inherent risks associated with transportation services.

Intellectual Property

All content, features, and functionality of our website, mobile application, and other service platforms, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of A Seven Eleven Taxi Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our intellectual property without our express written consent.

Privacy Policy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Modifications to Terms

A Seven Eleven Taxi Inc. reserves the right to modify these Terms at any time. We will notify users of material changes through our website, mobile application, or email. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of our services shall be resolved through:
  1. Informal negotiation – we encourage you to contact us first to attempt to resolve any disputes
  2. Mediation, if informal negotiation fails
  3. Binding arbitration in Ontario, if mediation fails

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Force Majeure

A Seven Eleven Taxi Inc. shall not be liable for any failure to perform its obligations where such failure is a result of acts of nature, government actions, war, civil unrest, labor disputes, or other causes beyond our reasonable control.
